REFUND, CANCELLATION & PAYMENT POLICY

1. INTRODUCTION

This Refund, Cancellation & Payment Policy (“Policy”) governs payments, billing, subscriptions, cancellations, refunds, credits, chargebacks, and related commercial matters for all products and services offered by MyWebSpace.

This Policy applies to:

  • MyWebSpace
  • Business OS
  • MaxMedia
  • AI Automation Services
  • Business Consulting
  • Custom Development
  • Enterprise Solutions
  • Subscription Services
  • Future Products and Services

This Policy forms an integral part of the MyWebSpace Terms & Conditions.

By purchasing or using any MyWebSpace Service, you agree to this Policy.


2. SCOPE

This Policy applies to:

  • Individual customers
  • Businesses
  • Schools
  • Educational institutions
  • Retail businesses
  • Clinics
  • Chartered Accountants
  • Manufacturers
  • Consultants
  • Government organizations
  • NGOs
  • Enterprise clients
  • Future customers of MyWebSpace

3. PAYMENT TERMS

Clients agree to pay all applicable charges in accordance with:

  • Approved quotations
  • Service agreements
  • Subscription plans
  • Invoices
  • Purchase orders
  • Statements of Work (SOW)
  • Enterprise contracts

Payments shall be made using approved payment methods made available by MyWebSpace.


4. ACCEPTED PAYMENT METHODS

Payments may be accepted through:

  • Bank Transfer
  • UPI
  • Credit Cards
  • Debit Cards
  • Net Banking
  • Online Payment Gateways
  • Digital Wallets
  • Cheques (where accepted)
  • Other approved payment methods

MyWebSpace reserves the right to modify accepted payment methods at any time.


5. BILLING

Invoices may include:

  • Subscription charges
  • Project charges
  • Implementation charges
  • Setup fees
  • Training fees
  • Consulting fees
  • Integration charges
  • Third-party expenses
  • Applicable taxes
  • Government levies

Clients remain responsible for verifying invoice accuracy and notifying MyWebSpace of any discrepancies within a reasonable period.


6. TAXES

Unless expressly stated otherwise, all prices are exclusive of applicable:

  • GST
  • VAT
  • Sales Tax
  • Withholding Tax
  • Government duties
  • Bank charges
  • Payment gateway charges

Clients remain responsible for taxes applicable to their jurisdiction.


7. SUBSCRIPTION SERVICES

Certain Services may be offered through recurring subscription plans.

Subscription plans may include:

  • Monthly
  • Quarterly
  • Annual
  • Enterprise
  • Custom subscriptions

Subscription fees become payable at the beginning of each billing cycle unless otherwise agreed.


8. AUTO-RENEWAL

Where automatic renewal is enabled, subscriptions shall automatically renew for the next billing period unless cancelled before the renewal date.

Users remain responsible for managing subscription renewals.

Where required by applicable law, renewal notifications may be provided.


9. PRICE REVISIONS

MyWebSpace reserves the right to revise pricing for:

  • New subscriptions
  • Renewals
  • Additional users
  • Additional storage
  • Additional AI credits
  • Additional modules
  • Enterprise plans
  • Future Services

Price revisions shall not affect invoices already paid unless otherwise agreed.


10. CUSTOM DEVELOPMENT PROJECTS

Custom development includes services such as:

  • Business OS implementation
  • MaxMedia implementation
  • Dashboard development
  • AI workflow development
  • Software customization
  • Integrations
  • Automation development
  • Consulting
  • Enterprise implementation

Each project shall be governed by its approved quotation or service agreement.


11. PROJECT MILESTONES

Where projects are divided into milestones, payments shall become due according to the milestone schedule agreed between the parties.

Failure to release milestone payments may result in suspension of work until outstanding payments are received.


12. ADVANCE PAYMENTS

Certain Services may require advance payment before work begins.

Advance payments enable MyWebSpace to allocate resources, personnel, infrastructure, software licenses, AI services, and project planning.

Unless otherwise agreed in writing, advance payments are generally non-refundable once work has commenced.


13. IMPLEMENTATION FEES

Implementation fees may include:

  • Project planning
  • Requirement analysis
  • Business process mapping
  • AI configuration
  • Dashboard setup
  • System installation
  • Workflow configuration
  • User onboarding
  • Data migration
  • Initial testing

Implementation work begins immediately after project initiation and may therefore become non-refundable once commenced.


14. CHANGE REQUESTS

Requests falling outside the approved scope may be treated as Change Requests.

Examples include:

  • Additional dashboards
  • Additional reports
  • Additional automation
  • Additional users
  • New AI modules
  • Additional integrations
  • UI redesign
  • Workflow changes
  • Feature enhancements
  • Additional revisions

Change Requests may require:

  • Revised quotations
  • Additional payments
  • Revised timelines
  • Separate agreements

No Change Request shall commence until approved by both parties.


15. CLIENT DELAYS

Delays caused by the Client may include:

  • Delayed approvals
  • Missing information
  • Incomplete documentation
  • Delayed feedback
  • Delayed payments
  • Frequent scope changes
  • Failure to attend scheduled meetings

Project timelines may be revised where Client delays occur.

Additional charges may apply where delays substantially increase project effort.

16. REFUND ELIGIBILITY

Refund eligibility depends upon the nature of the Service purchased.

Unless expressly stated otherwise in a written agreement, refunds shall be governed by this Policy.

Refunds, where approved, shall be processed only to the original payment source or through another lawful method determined by MyWebSpace.


17. NON-REFUNDABLE SERVICES

The following payments are generally non-refundable once work has commenced or the applicable service has been activated:

  • Consultation fees
  • Discovery sessions
  • Business analysis
  • Requirement gathering
  • Business Health Checks
  • AI strategy sessions
  • Project planning
  • Software implementation
  • Business OS setup
  • MaxMedia setup
  • AI workflow configuration
  • Dashboard configuration
  • Data migration
  • User onboarding
  • Training services
  • Installation services
  • Custom software development
  • API integration
  • Third-party software procurement
  • Domain registration
  • Domain renewal
  • Cloud hosting charges
  • SSL certificates
  • Email hosting
  • Premium plugins
  • Third-party licenses
  • AI service credits
  • Content creation services
  • Video editing services
  • Content repurposing services
  • Graphic design services
  • Completed milestones
  • Professional services already delivered

18. SUBSCRIPTION REFUNDS

Subscription fees are generally non-refundable once the subscription period has commenced.

Cancellation of a subscription prevents future billing but does not automatically entitle the Client to a refund for the current billing period unless required by applicable law.


19. UNUSED SERVICES

Failure to use purchased Services does not automatically create a right to:

  • Refund
  • Credit
  • Cash reimbursement
  • Partial reimbursement

unless otherwise agreed in writing.


20. REFUNDS FOR DUPLICATE PAYMENTS

If a Client accidentally makes duplicate payments for the same invoice, MyWebSpace may, after verification, either:

  • Refund the duplicate amount; or
  • Adjust the duplicate payment against future invoices,

at the Client’s request and subject to applicable accounting procedures.


21. FAILED TRANSACTIONS

Where a payment transaction fails but funds are debited from the Client’s account, resolution shall generally be governed by the applicable payment gateway or banking institution.

MyWebSpace will provide reasonable assistance in verifying transaction status where requested.


22. CHARGEBACKS

Clients agree not to initiate chargebacks or payment disputes in bad faith.

Before initiating any chargeback, Clients are encouraged to contact MyWebSpace to attempt resolution.

Where an improper or fraudulent chargeback is initiated, MyWebSpace reserves the right to:

  • Suspend Services
  • Recover outstanding amounts
  • Recover bank charges
  • Recover legal costs where permitted by law
  • Terminate subscriptions
  • Restrict future purchases

Nothing in this clause limits any statutory rights available to the Client.


23. CANCELLATION BY CLIENT

Clients may cancel Services by providing written notice through the official communication channels specified by MyWebSpace.

Cancellation shall become effective in accordance with:

  • Applicable subscription terms
  • Project agreement
  • Service contract
  • Statement of Work
  • Enterprise agreement

Cancellation does not automatically release the Client from payment obligations for Services already performed or committed.


24. CANCELLATION BY MYWEBSPACE

MyWebSpace reserves the right to suspend or cancel Services where:

  • Payment remains overdue;
  • The Client materially breaches the Terms & Conditions;
  • Fraud is suspected;
  • Illegal activities are detected;
  • The Services are misused;
  • Security risks arise;
  • Required cooperation is not provided;
  • Continuation of the Services becomes unlawful.

Where reasonably practicable, prior notice may be provided.


25. TERMINATION OF PROJECTS

Where a project is terminated before completion:

  • Payment shall remain due for work completed up to the termination date.
  • Completed deliverables may be released only after settlement of outstanding amounts.
  • Partially completed work may remain the intellectual property of MyWebSpace unless otherwise agreed in writing.

26. THIRD-PARTY COSTS

Third-party expenses incurred specifically for a Client are generally non-refundable.

These may include:

  • Domain registrations
  • Hosting plans
  • Cloud infrastructure
  • AI platform subscriptions
  • Software licenses
  • Premium APIs
  • SMS credits
  • Email credits
  • Payment gateway setup fees
  • External consulting fees
  • Government fees

Refunds relating to third-party services shall remain subject to the policies of the respective provider.


27. REFUND PROCESS

Where a refund is approved, the Client may be required to provide:

  • Invoice number
  • Payment reference
  • Reason for refund request
  • Supporting documentation where applicable
  • Identity verification where reasonably required

Incomplete requests may delay processing.


28. REFUND TIMELINE

Approved refunds shall ordinarily be processed within a commercially reasonable period.

Actual credit timelines may depend upon:

  • Banking institutions
  • Payment gateways
  • Card issuers
  • Financial intermediaries
  • Applicable regulations

MyWebSpace shall not be responsible for delays caused by financial institutions or payment service providers after the refund has been initiated.


29. SERVICE CREDITS

In certain circumstances, MyWebSpace may, at its sole discretion, offer:

  • Service credits
  • Additional subscription time
  • Replacement Services
  • Future invoice adjustments

instead of a monetary refund where appropriate and acceptable to the Client.

Such service credits do not constitute an admission of liability.


30. FORCE MAJEURE

Refunds shall not ordinarily be available for delays or interruptions caused by events beyond the reasonable control of MyWebSpace, including but not limited to:

  • Natural disasters
  • Government restrictions
  • Internet outages
  • Cybersecurity incidents
  • Cloud infrastructure failures
  • War
  • Civil disturbances
  • Pandemic-related disruptions
  • Utility failures
  • Third-party service interruptions

31. CHANGES TO THIS POLICY

MyWebSpace reserves the right to amend, revise, or replace this Refund, Cancellation & Payment Policy from time to time.

Material updates may be communicated through:

  • Website notices
  • Email communications
  • Dashboard notifications
  • Other reasonable communication methods

Continued use of the Services after the effective date of any revised Policy constitutes acceptance of the updated Policy.


32. GOVERNING LAW

This Policy shall be governed by and interpreted in accordance with the laws of the Republic of India.

34. ACKNOWLEDGEMENT

By purchasing, subscribing to, or using any MyWebSpace Service, including Business OS, MaxMedia, AI automation services, and future products, you acknowledge that you have read, understood, and agree to this Refund, Cancellation & Payment Policy.
